An act to amend Sections 44930 and 45201 of the Education Code,
relating to school employees.

	LEGISLATIVE COUNSEL'S DIGEST

AB 1135, Ashburn. School employees: resignations.
Existing law prohibits the resignation of a school employee from
taking effect after the close of the school year during which the
governing board of a school district receives the resignation.
This bill would, notwithstanding the above, authorize an employee
and the governing of a school district to agree that a resignation
will be accepted at a mutually agreed upon date not later than 2
years beyond the close of the school year during which the
resignation is received by the board.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 44930 of the Education Code is amended to read:

44930. (a) Governing boards of school districts shall accept the
resignation of any employee and shall fix the time when the
resignation takes effect, which, except as provided by subdivision
(b), shall not be later than the close of the school year during
which the resignation has been received by the board.
   (b) Notwithstanding any other provision of law, an employee and
the governing board of a school district may agree that a resignation
will be accepted at a mutually agreed upon date not later than two
years beyond the close of the school year during which the
resignation is received by the board.
SEC. 2. Section 45201 of the Education Code is amended to read:
45201. (a) The governing boards of any school district may accept
the resignation of any employee and may fix the time when the
resignation shall take effect, which, except as noted in subdivision
(b), shall not be later than the close of the school year during
which the resignation is received by the board.
   (b) Notwithstanding any other provision of law, an employee and
the governing board of a school district may agree that a resignation
will be accepted at a mutually agreed upon date not later than two
years beyond the close of the school year during which the
resignation is received by the board.
